1. Acceptance of Terms
If you do not agree to these Terms, do not use Marvel Bot. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Marvel Bot is a cloud-based platform that enables users to:
- Create and configure AI-powered chatbots
- Analyze websites and upload documents to build knowledge bases
- Deploy embeddable chat widgets on websites
- View analytics and manage account settings
Features, limits, and availability may change. Access may require administrator approval and is subject to usage quotas (e.g. token limits and maximum number of chatbots).
3. Account Registration & Approval
- You must provide accurate and complete registration information.
- New accounts may require approval by a Marvel Bot administrator before full access is granted.
- You are responsible for safeguarding your login credentials and all activity under your account.
- You must notify us promptly of any unauthorized access at contact@marvelsoft.ai.
4. Acceptable Use
You agree not to use Marvel Bot to:
- Violate any applicable law, regulation, or third-party rights
- Upload or distribute malware, spam, or harmful code
- Harass, defraud, impersonate, or mislead others
- Generate or disseminate illegal, hateful, or explicitly violent content
- Scrape, crawl, or access websites without proper authorization or robots.txt compliance
- Attempt to bypass usage limits, security controls, or authentication
- Reverse engineer, resell, or sublicense the platform except as expressly permitted
- Use the service in high-risk contexts (e.g. emergency services, medical diagnosis) without human oversight
5. Your Content & Licenses
You retain ownership of content you submit (website data, documents, prompts, chat logs, branding). By using Marvel Bot, you grant MarvelSoft AI a limited, worldwide, non-exclusive license to host, process, reproduce, and display your content solely to operate and improve the service, including transmitting data to AI providers as needed to generate responses.
You represent that you have all necessary rights to submit content and that your chatbots comply with applicable laws and your own privacy obligations to end-users.
6. AI-Generated Output
Marvel Bot uses artificial intelligence. AI responses may be inaccurate, incomplete, or outdated. You are solely responsible for reviewing outputs before relying on them. MarvelSoft AI does not guarantee the accuracy, legality, or suitability of AI-generated content.
7. Third-Party Services & API Keys
The platform may integrate with third-party AI providers and infrastructure services. If you supply your own API keys, you are responsible for compliance with those providers' terms and for any fees they charge. MarvelSoft AI is not liable for third-party service interruptions or policy changes.
8. Usage Limits & Fair Use
Administrators may assign token allowances, chatbot limits, and other quotas. Exceeding limits may result in restricted functionality until limits are increased. We may suspend accounts that place unreasonable load on the platform or abuse resources.
9. Fees & Payment
Marvel Bot may be offered on free, trial, or paid plans as determined by MarvelSoft AI. If paid features are introduced, additional payment terms will be provided. Failure to pay applicable fees may result in suspension.
10. Intellectual Property
Marvel Bot, its software, branding, documentation, and underlying technology are owned by MarvelSoft AI or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary materials except limited use necessary to operate the service.
11. Confidentiality
Each party agrees to protect the other's confidential information shared in connection with the service and to use it only for permitted purposes, except where disclosure is required by law.
12. Suspension & Termination
We may suspend or terminate your access if you:
- Breach these Terms or the User Agreement
- Pose a security risk or legal liability
- Remain in pending/rejected status or violate approval conditions
You may stop using the service at any time. Upon termination, your right to access Marvel Bot ceases. Provisions that by nature should survive (e.g. liability limits, IP, governing law) will survive.
13. Disclaimers
MARVEL BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARVELSOFT AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF MARVEL BOT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO MARVELSOFT AI FOR MARVEL BOT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless MarvelSoft AI from claims, damages, and expenses (including reasonable legal fees) arising from your content, your chatbots, your violation of these Terms, or your violation of any third-party rights.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local consumer protections apply. Disputes shall be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
17. Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use after changes constitutes acceptance. Material changes may be notified by email or in-app message.
